Controversies

  1. Simbhaoli Sugar Mill Fraud Case (2018)
Justice Varma’s name surfaced in 2018 in connection with the Simbhaoli Sugar Mill fraud case, investigated by the Central Bureau of Investigation (CBI). The case involved allegations against the company for misappropriating a ₹97.85 crore loan provided by the Oriental Bank of Commerce, which was intended to benefit farmers. Investigators claimed that the funds were redirected for other purposes instead. At the time, Justice Varma held the position of a non-executive director at Simbhaoli Sugars, leading to his inclusion in the First Information Report (FIR). Despite the severity of the allegations, the case gradually lost momentum, and no significant legal action was taken against any of the individuals named in the FIR, including Justice Varma.
  2. Cash Recovery Incident (2025)
In March 2025, an unexpected incident at Justice Varma’s official residence brought renewed scrutiny over his financial dealings. A fire broke out at his home, and during the firefighting efforts, authorities reportedly discovered a significant amount of cash, estimated at ₹15 crore, in a storeroom. This discovery reignited discussions about his previous involvement in financial controversies, particularly the 2018 Simbhaoli Sugar Mill case. In light of the unfolding controversy, the Supreme Court Collegium, headed by Chief Justice of India Sanjiv Khanna, decided to transfer Justice Varma back to the Allahabad High Court. Meanwhile, Delhi High Court Chief Justice DK Upadhyaya initiated an in-house inquiry to gather evidence and ascertain further details regarding the alleged cash recovery.

Justice Varma’s Response Reacting to the allegations, Justice Varma categorically denied having any knowledge about the cash found at his residence. He maintained that neither he nor any of his family members had stored the money in the storeroom. Additionally, he suggested that the entire incident could be part of a deliberate attempt to tarnish his reputation. Expressing concern over the manner in which the media portrayed him, he stated that he was deeply disappointed with the reports that prematurely indicted him without a thorough investigation.

Current Status As of March 2025, investigations into the cash recovery incident are still ongoing. The Supreme Court has published an initial inquiry report that includes Justice Varma’s official response and visual evidence related to the fire incident. A specially appointed three-member committee continues to examine the matter in detail, with further developments anticipated in the coming weeks.

Justice Varma, whose career has been marked by significant legal and judicial contributions, now faces heightened scrutiny due to these controversies. The outcomes of the ongoing investigations will play a crucial role in determining the future trajectory of his professional standing and judicial tenure.
